BARROW COUNTY, GA — The father of the accused Apalachee High School shooter appeared in court on Friday.
54-year-old Colin Gray is accused of giving his son Colt Gray, the gun used in the deadly attack that left two students and two teachers dead.
Last month, his trial date was postponed over scheduling issues with his defense team.
Colin Gray faces a number of charges, including two counts of second-degree murder, 19 counts of second-degree cruelty to children, and four counts of reckless conduct.
Gray has pleaded not guilty.
After the hearing, Barrow County Superior Court Judge Nicholas Primm is considering whether to leave out certain evidence in the trial.
Attorneys for Gray say law enforcement conducted an illegal search of his property following the shooting last September and they want evidence collected that day omitted from trial.
They say the officers searched Gray’s home without a warrant and without his consent, but District Attorney Brad Smith says bodycam footage shows something different.
Smith contends that even without a warrant, law enforcement on scene at Colin Gray’s home were granted access by Gray himself
The judge says he will rule in the next 30 days.
